Notice of Uninhabitability
At Longmont Property Group, we are committed to providing safe and livable homes for all tenants. If you believe your rental unit has become uninhabitable due to conditions that significantly impact your health, safety, or ability to reasonably live in the unit, Colorado law allows you to notify us in writing.
How to Submit a Notice of Uninhabitability
Tenants may notify us of uninhabitable conditions in any of the following ways:

Examples of Uninhabitable Conditions:
Under Colorado Revised Statutes Section 38-12-505, the following are examples of conditions that may be considered uninhabitable if not resolved in a reasonable time:
- No running water or lack of functioning plumbing
- No working heat during cold weather
- No electricity or persistent electrical hazards
- Gas leaks or exposure to hazardous fumes
- Significant mold, sewage, or pest infestations
- Broken or missing doors or windows that compromise security
- Structural hazards that risk collapse or injury
- Non-functional smoke or carbon monoxide detectors
Note: These conditions must not be caused by tenant negligence or misuse.
What Happens Next?
Once we receive your written notice, we will:
- Evaluate the reported issue promptly
- Coordinate a repair timeline or resolution plan
- Communicate with you on next steps and timing
If a condition is verified as uninhabitable and not resolved within a reasonable timeframe, Colorado law may entitle tenants to remedies such as withholding rent, repairing and deducting costs, or terminating the lease.
